General Information

It is the document that establishes the principles, requirements, and conditions for applying, approving, and monitoring audiovisual projects that aspire to the CINA (Certificate of Audiovisual Investment in Colombia) or cash rebate from the FFC (Colombian Film Fund) , according to Law 1556 of 2012 and its amendment in 2019.

This tool is an informative resource to facilitate understanding of the Resource Allocation Manual and the application process for the incentives of Law 1556 of 2012. It does not replace the producer’s responsibility to consult official and binding sources. In case of discrepancy, the latter prevail. Proimágenes assumes no responsibility for decisions made based exclusively on the application.

The Colombian Film Promotion Committee (CPFC) may set, within the last two (2) months of each year, the maximum CINA quota to be awarded the following year, and determine the maximum CINA approved per project.

The CPFC may set the maximum FFC quota within the first two (2) months of each year. It also establishes and modifies the maximum amount of cash rebate approved per project based on the FFC budget, the types of works, and the applications. At least 50% of the FFC allocated for each year is earmarked for cinematographic works, unless there are insufficient applications.

Legal and administrative terms

Incentive instruments

These are incentive systems created under Colombian law to promote the development of audiovisual works in the country. These are the Colombian Film Fund (FFC) and CINA (Certificate of Audiovisual Investment in Colombia).

FFC cash rebate

Financial resources given to a producer when their project is approved and once they have demonstrated compliance with the application requirements.

Management entity

Proimágenes Colombia, the entity responsible for the evaluation, accreditation, and execution processes set forth in the Resources Allocation Manual (MAR).

Applicant producer

A person who submits their audiovisual project for funding.
  • For the CINA, this is a foreign legal entity that does not file income tax returns in Colombia.
  • For the FFC, it can be a national legal entity—a Colombian production company—or a foreign legal entity, which carries out all the procedures through a film services company (SSC) or co-production company registered in Colombia, under a power of attorney or mandate. This SSC must be registered with the Film Information and Registration System (SIREC).

Producer

A person who has the initiative, coordination, and responsibility for the production of the audiovisual work. They are responsible for entering into contracts with the persons and entities involved in the realization of the project, as well as being the owner of the economic rights to the work.

Production

Work related to audiovisual production in its various stages of conception and realization.

Post-production

Includes, among other services or activities, video or audio editing, color correction, colorization, visual effects, animation, sound design or mixing, creation of foleys, location services, dubbing, subtitling, closed captioning, audio description, mastering, capture and synchronization of material, and reproduction or copying. The digital downloading of material or previews during production is not considered post-production.

Film services company (SSC)

A legal entity legally incorporated in Colombia and registered at the SIREC of the Ministry of Culture, Arts, and Knowledge, whose purpose includes providing audiovisual services in the country.

Colombia Filming Contract

Negocio jurídico entre el productor postulante y Proimágenes, una vez el proyecto postulado es aprobado por el CPFC. Establece las condiciones de asignación de los estímulos CINA o FFC.

Colombian Film Promotion Committee (CPFC)

Decision-making body for incentive instruments. It approves or rejects projects submitted to CINA or FFC.

Bid Bond

Mandatory payment that ensures the producer's commitment when applying for a project.
  • In CINA, it is equivalent to 2.2% of the expenditure subject to incentive, with a cap of eighty (80) SMLMV (Colombian minimum monthly wage).
  • In the FFC, it corresponds to a fixed value of forty (40) SMLMV.
In both cases, if the project is rejected or withdrawn before being evaluated by the CPFC, 90% of the amount paid is refunded.

Covered projects

Audiovisual work

Any creation expressed through a series of associated images, with or without incorporated sound, intended to be shown through projection devices or other means of image and sound communication, regardless of the physical medium or form of dissemination.

Cinematic work

Audiovisual work—short or feature film—that uses cinematic language, referring to real or imaginary events, resulting from the fixation in images, with or without sound, of forms capable of being perceived by the human eye, so that when reproduced, it creates an impression of movement.
  • National cinematographic work: a work that meets the requirements established in Decree 1080 of 2015, and any other regulation that modifies or recognizes equivalencies in this regard.
  • Foreign cinematographic work: a work that, although produced in accordance with national standards, does not meet the requirements to be considered national.

Series

Serialized audiovisual work divided into chapters, whose genre may be fiction, documentary, or non-scripted formats. It is considered an audiovisual work for the purposes of registration, incentives, or rights if it complies with the characteristics established in the general regulation of audiovisual works.

Music video

An audiovisual piece that accompanies the performance of a musical or artistic work, not necessarily with a fictional narrative, which is disseminated through audiovisual media.

Video game

Interactive application that combines audiovisual content, software development, user interface, narrative, sound, and image.

Advertising audiovisual production

Audiovisual production created for promotional, commercial, or advertising purposes for products, services, brands, among others.

Non-scripted work

Content without a pre-established script, such as reality shows, game shows, entertainment programs, or productions that rely heavily on spontaneity or unscripted interaction.

Non-national audiovisual work

Work with significant foreign financial, technical, or artistic participation.

Short web series

Serialized audiovisual work with short episodes, produced for digital platforms or social networks. Its genre can be fiction, documentary, non-scripted, or animation. To apply for institutional calls for proposals, the minimum/maximum duration, quality requirements, copyright, and other information must be specified.

Eligible services

Audiovisual Services (SA)

Specialized activities directly related to the pre-production, production, and post-production of audiovisual works, including artistic and technical services. They must be provided by Colombian individuals or legal entities domiciled or resident in Colombia.

Audiovisual Logistics Services (ALS)

Include hotel, food, and transportation items necessary for the audiovisual project. They must be contracted with Colombian individuals or legal entities domiciled or resident in the country for incentive and regulatory purposes.

National project services

Understood as the combination of the project's SA and SLA, when such services are provided in Colombia by natural or legal persons domiciled/resident in the country. Services contracted abroad are not accepted for inclusion in the project's national services and therefore do not apply for the purposes of incentives such as CINA or FFC compensation.

Expenditure and requirements

Total expenditure budget in the country

Itemized document of the projected amounts to be invested in Colombia, classified into Audiovisual Services (SA) and Audiovisual Logistics Services (SLA), taxes, and other expenses.

Expenditure budget subject to CINA

Expenses in AS and ALS contracted in Colombia that are eligible to receive the incentive, excluding VAT.

Budget subject to compensation

Expenses in AS and ALS contracted in Colombia that are eligible to receive compensation from the FFC, excluding VAT.

Minimum expenditure in the country

Minimum amount of investment in SA and SLA in Colombia required to access the incentives, according to the type of work indicated in the Resources Allocation Manual (MAR). It is calculated based on the SMLMV in Colombia, in the same year the project is approved.

Current Legal Monthly Minimum Wage (SMLMV)

Legal reference that is updated annually in Colombia and used as the basis for calculating minimum expenditure and deposit amounts.

Contributions to the Comprehensive Social Security System

Payments provided for by the current Social Security System in Colombia to guarantee health coverage and complementary services.
What does the MAR say about this?
Accounting and financial terms

Account entry

Electronic registration in DECEVAL, the Centralized Securities Depository of Colombia, which certifies the holder as the owner of a security.

Dematerialization

Replacement of a physical security with an electronic account entry.

Withholding tax

Tax collection mechanism applied at the time of payment.

Self-withholding on income

When the taxpayer directly applies the withholding of their income tax.

Security

Financial document that grants negotiable economic rights, such as bonds or shares.

The trust

A contract whereby a trust entity manages the resources of an audiovisual project in Colombia.
Financial system players

Bank

Financial entity authorized to collect taxes. It may also receive CINA as a means of payment for self-withholding or income tax discounts.

Brokerage firm

Authorized intermediary in the securities market responsible for trading CINA.

Direct depositor

Entity endorsed by the Financial Superintendency of Colombia to manage securities, including the receipt and transfer of CINAs.
Stock market terms

DECEVAL

Centralized Securities Depository of Colombia. It manages CINA electronically.

Secondary market

Space where securities that have already been issued are traded. Currently, it operates through electronic platforms.

Over-the-counter (OTC) trading

Direct trading between parties outside the stock exchange. To be valid, it must be registered through a direct depositary in the electronic system.

Master Trader

Electronic platform of the Colombian Stock Exchange used to trade securities, including CINA.

National Registry of Securities and Issuers

Official registry of the Financial Superintendency of Colombia where CINA must be registered in order to be publicly traded.

The Resource Allocation Manual sets out the basic rules for applying for, approving, and monitoring audiovisual projects carried out in Colombia.

Equality: All projects are evaluated using uniform criteria, without giving priority or preference to any of them.

Responsibility: Failure to comply with the project will result in the consequences set forth in the Resources Allocation Manual (MAR) and the Colombia Filming Contract

Veracity: The information submitted by the producer is presumed to be true, and the producer must clarify any doubts. Only expenses incurred in Colombia are recognized, and Proimágenes may carry out the relevant checks.

Concurrence: The same producer may submit more than one project to the CPFC.

Information for producers: The information provided does not constitute advice nor does it guarantee the allocation of the incentive.

Application costs: These are borne entirely by the producer.

Application of deadlines: Deadlines are counted in business days in Colombia. If the expiration date falls on a holiday or weekend, it is moved to the next business day.

Rights: The allocation of any of the incentives does not confer any property rights on Proimágenes nor does it make it responsible for the project. The producer is directly and independently liable to Proimágenes and third parties for any matter related to the application.

Publicity: Proimágenes and the CPFC may provide information about the project to the relevant public entities.

What does the MAR say about this?

Formats: Proimágenes may create, update, or delete formats or forms when the Resources Allocation Manual (MAR) is modified or when management needs require it, in order to facilitate processes.

Representative or agent: The foreign producer may carry out all actions and procedures related to the incentive instruments through the film services company or the national co-producer of the project. The designated SSC acts under a power of attorney or mandate, always on behalf of and for the account of the foreign producer, and all relationships, obligations, and rights are understood to be exclusively with respect to the latter.

Autonomy of will: When applying for a project, the producer declares that they are familiar with the regulations of CINA and the FFC, and that they are willing and able to comply with them.

Reporting of information: The CPFC, Proimágenes, and the Ministry of Culture, Arts, and Knowledge may report expense accreditation information to the National Tax and Customs Directorate, the Financial Investigation and Analysis Unit, or any other administrative or judicial authority that requires it.

Applications in progress: Projects in the application and evaluation process are subject to the provisions of the current Resources Allocation Manual (MAR).

Meeting schedule: The CPFC publishes its meeting schedule each year on the Colombian Film Commission website, subject to change.

Knowledge transfer: The CPFC determines by agreement the requirements for knowledge transfer to the audiovisual community by producers applying for any of the incentive instruments. If deemed necessary, it may also set minimum requirements for the hiring of national talent to be involved in the project.

Elimination of red tape: Documents with extended validity may be defined to avoid repetition of procedures.

Validity and repeals: The Resources Allocation Manual (MAR) comes into force on the date of its publication and repeals all previous versions.

Opportunity: Applications are made through the technological platform defined by Proimágenes.

What does the MAR say about this?

Anyone applying for the incentives regulated by the Resources Allocation Manual (MAR) authorizes the use of materials from their project or their incorporation into public institutional content, without time limits, for all territories, media, and formats. This is for cultural and non-commercial purposes, intended to promote Colombia as an audiovisual production setting.

Producers applying for any of the incentive instruments must comply with the following obligations:

Cultural and non-commercial use of materials
  • Authorize the use of up to five (5) minutes of images from the work.
  • Authorize the use of testimonial and behind-the-scenes audiovisual material.
  • Authorize the use of photographs of the work.
Delivery of materials
  • Deliver the copies required for the use of the authorized materials in optimal technical quality under industry standards.
Dissemination and communication
  • Agree that the Film Commission will organize press conferences, press launches, or similar events.
  • Coordinate with Proimágenes to draft press releases for national and international media to positively publicize the effect of the national incentive system.
  • Agree to the visit of five (5) government representatives to the set with at least one (1) person from the main cast and one (1) person from the main technical or artistic team.
Lists and data
  • Provide a list of locations indicating the geographical location, address, and details of each site.
  • Provide a list with anonymous statistical data on all Colombian members of the technical and artistic team.
Graphic material
  • Provide at least six (6) non-promotional still photos of the cast and the technical and artistic team on location.
  • Provide at least three (3) testimonials, either on video or in writing, from senior international members of the technical and artistic team about their experience filming in Colombia.
Knowledge transfer
  • At least one (1) department head must participate in a question-and-answer session with representatives of the local audiovisual industry or students.
Credits
  • Give credits to the country and the authorities responsible for the incentive instruments of Law 1556 of 2012. These are defined in the Colombia Filming Contract, taking into account the particularities of the types of works covered.
What does the MAR say about this?

FAQ

¿Se puede obtener el incentivo del FFC y del CINA con el mismo proyecto?
No. Los instrumentos son excluyentes. Un proyecto solo puede presentarse a uno de los dos. No se aceptan postulaciones duplicadas ni que sean beneficiarias de la Ley 814 de 2003 (FDC).

¿Puede un proyecto de solo postproducción aplicar?
Sí, al CINA, si cumple el gasto mínimo (COP 630.325.800. ) y se presenta como proyecto independiente. Al FFC únicamente se aplican proyectos que con anterioridad a la postulación hubieran sido destinatarios del FFC para producción.

¿Cuáles son los gastos no cubiertos por los incentivos?
No están cubiertos: gastos fiduciarios, auditorías, administración de valores por depositantes, compras de bienes, ni gastos que no sean servicios audiovisuales o logísticos prestados por personas naturales o jurídicas colombianas.

¿El productor debe ser el propietario de los derechos patrimoniales de la obra?
Sí. El productor, como responsable del proyecto, debe ser titular de los derechos patrimoniales, salvo que se pacte lo contrario legalmente.

¿La sociedad de servicios cinematográficos debe ser coproductora?
No. Puede ser simplemente contratista. Para proyectos no nacionales, los servicios deben contratarse por intermedio de una sociedad registrada como prestadora de servicios cinematográficos, sin necesidad de que sea coproductora.

¿Es necesario que el productor esté legalmente constituido?
Sí. El productor debe ser una persona jurídica (o su equivalente extranjero) legalmente constituida.

En el caso del CINA, debe tratarse de productores extranjeros no declarantes de renta en Colombia.

¿Existe alguna restricción si el productor extranjero tiene filiales en Colombia?
No. Las filiales pueden actuar como sociedades de servicios cinematográficos si están registradas ante el Ministerio de Cultura y su objeto social incluye dichos servicios.

¿Se puede postular una idea para publicidad?
Sí. En producción audiovisual publicitaria se permite postular una idea, con aprobación posterior por parte de la Sociedad de Servicios Cinematográficos.

¿Se pueden postular dos temporadas de una serie en una sola postulación?
No, Cada temporada debe hacer una postulación por separado

¿Cuáles proyectos no pueden postularse?
Aquellos que ya recibieron FFC (excepto postproducción) o CINA, ni beneficiarios de FDC, ni de la ley 814, ni aquellos que tienen vínculos con miembros del CPFC o empresas inhabilitadas.

¿Qué pasa si la postulación del proyecto está incompleta?
No puede agendarse para la sesión del CPFC. Se requiere presentación completa y estar habilitado por la entidad de gestión con al menos 5 días hábiles de antelación.

¿Qué sucede si el proyecto es desaprobado por el CPFC o se retira antes de ser evaluado por el CPFC?
El productor puede solicitar el reintegro del 90% del valor de la cobertura de la seriedad.

¿Qué sucede si el proyecto desiste después de ser aprobado?
El productor puede desistir en cualquier momento, perdiendo el valor de la cobertura de seriedad.

¿Se puede ampliar el presupuesto de un proyecto ya aprobado?
Sí. Hasta el 50% del valor del gasto sujeto a CINA o contraprestación, sin necesidad de suscribir otro sí.

¿Existe un cronograma con fechas específicas para aplicar?
No. La convocatoria está abierta todo el año. FFC se otorga hasta agotar el presupuesto asignado por el Gobierno Nacional; CINA, hasta agotar el cupo fiscal aprobado por el CPFC.

¿Qué ocurre si no se presentan las certificaciones?
Se considera desistimiento. Se libera el cupo asignado.

¿Se pueden emitir varios CINA por un mismo proyecto?
Sí. Se permiten emisiones parciales según los montos acreditados.

¿Puedo fraccionar los CINA de un mismo proyecto?
Sí, el productor extranjero puede negociar el CINA parcial o totalmente. El beneficiario o tenedor del título puede dar la instrucción de la operación por el valor que requiera a través de su depositante directo quien se encarga de realizar los fraccionamientos y cumplir la operación en el Depósito de Valores.

¿Se pueden vender los CINA?
Sí, a personas naturales o jurídicas que sean declarantes de renta en Colombia, en el mercado bursátil a través de una sociedad comisionista de bolsa o una operación extrabursátil en el mercado OTC.

¿Cómo identificar a posibles compradores del CINA?
Una forma es a través de una firma comisionista, que identifica empresas o personas que requieran pagar impuestos de autorretención y renta en Colombia. Otra manera es contactando directamente a personas naturales o jurídicas declarantes del impuesto de renta en Colombia.

¿Puedo negociar los CINA sin un comisionista?
Sí. Es posible hacerlo mediante una operación extrabursátil -OTC- negociación directa entre las partes, requiere al depositante directo para el registro de la operación en el sistema electrónico.

¿Quiénes están habilitados como comisionistas?
Cualquier firma comisionista puede actuar como depositante directo de valores. Cada firma decide si acepta o restringe la custodia o negociación de los CINA.

¿Se puede acceder al CINA sin haber terminado el proyecto audiovisual?
Sí, siempre que se haya acreditado el gasto mínimo exigido por el programa.

¿Cuál es el proceso de recepción del CINA por parte del productor extranjero?
1. El CINA es emitido por el Ministerio de Cultura a través de DECEVAL, a favor del productor extranjero.
2. El productor debe estar vinculado a una sociedad comisionista de bolsa o depositante directo.
3. El depositante directo recibe el CINA en una subcuenta del productor y realiza la instrucción de venta o traslado que le dé el productor.

¿Se pueden usar los CINA como garantía bancaria?
Sí. Pueden hacer parte de un paquete financiero respaldado por flujo de caja, preventas y distribución

3. Article 3. Object. This Resource Allocation Manual establishes the principles, requirements and conditions for the application, approval, follow-up, and coverage of audiovisual projects with the consideration from the Colombia Film Fund or with the tax discount covered by Certificates of Audiovisual Investment in Colombia, as provided for in Law 1556 of 2012, as amended by Law 1955 of 2019.

Article 24. Annual Allocation. The CPFC may set and, if necessary, modify the maximum amount of the FFC’s cash rebate that can be assigned per project each year. This determination will be based on the FFC’s budget, the typologies, or genres of works, existing or anticipated applications, among other factors.
In accordance with Article 2.10.3.3.5 of Decree 1080 of 2015, amended by Decree 474 of 2020, no less than fifty percent (50%) of the FFC allocated each year for cash rebates will be designated for feature films, unless there are insufficient or unendorsed applications by the CPFC. This percentage will be determined by the CPFC within the first two (2) months of each year and may be modified during the year according to the typology of the submitted or anticipated projects. 

Article 44. Annual quota. The CPFC is responsible for setting, for each fiscal year, the total CINA quota that may be issued for that period. Likewise, if necessary, it may determine maximum CINA quotas per project.
CHAPTER

What does the MAR say about this?

4. Article 4. Use of terms. For the purposes of this Manual, the following concepts and acronyms shall be observed:

4.1. Incentive instruments of Law 1556 of 2012. This concept will be used in this Manual to jointly designate the incentive systems established in Law 1556 of 2012, as amended by Articles 177 and 178 of Law 1955 of 2019, to promote the development of audiovisual works in the Colombian territory.
These instruments are, on the one hand, the FFC’s Cash Rebate and, on the other hand, the tax rebate covered by Certificates of Audiovisual Investment in Colombia.

4.3. FFC’s Cash Rebate. FFC resources allocated to the producer whose audiovisual project has been approved by the CPFC, once all the conditions set out in the FFC regulations have been met.

4.29. Management Entity. It refers to the non-profit entity that, through a partnership with the Ministry of Commerce, Industry and Tourism (in the case of the FFC), and the Ministry of Cultures, Arts and Knowledge (in the case of the tax rebate under CINA), carries out the management of the different processes foreseen in this Manual. This Management Entity is Proimágenes Colombia.

4.30. Proimágenes Colombia. ‘Fondo Mixto de Promoción Cinematográfica’, created in accordance with Article 46 of Law 397 of 1997, is an autonomous, non-profit civil corporation with state and private members, governed by private, civil and commercial law.
By decision of the Ministry of Commerce, Industry and Tourism; of the Ministry of Cultures, Arts, and Knowledge; and of the Colombia Film Promotion Committee; respectively, and based on decree 1080 of 2015, modified by decree 474 of 2020 and the relevant agreements entered into with these entities, it is the civil corporation that carries out the management of the FFC. It is also the Technical Secretariat of the CPFC and operates as the National Film Commission.
In this Manual, it will be referred to as Proimágenes, Technical Secretariat, or as the Management Entity, as appropriate.

4.21. Applicant producer. Producer who applies with an audiovisual project to the incentive instruments of Law 1556 of 2012. In this Manual, it may be referred to as producer or production company. 

4.20. Producer: The one who has the initiative, coordination, and responsibility for the production of the audiovisual work. It is responsible for entering into contracts with the individuals and entities involved in the production of the work, and is the holder of the economic rights of the work.
Only audiovisual projects whose producers are legal entities may apply to the incentive instruments of Law 1556 of 2012. 

4.28. Production. This refers to work related to audiovisual production in its different stages of conception and realisation. In this Manual, the production stage is differentiated from the post-production stage.
Post-production incorporates, among other services or activities, those of: video or audio editing; colour correction; colourisation; visual effects; animation; sound design or mixing; foli creation; localisation services; dubbing; subtitling; closed captioning; audio description; mastering; ingest and synchronisation of material; and playback or copying. For this manual, post-production does not include the processes of digital downloading of material or previews during production, which are part of the production stage. 

4.19. Film services company: A legal entity legally incorporated in Colombia and registered in the Registry of Film Service Providers of the Ministry of Cultures, Arts and Knowledge, whose object includes the provision of film services. 

4.6. Colombia Filming Contract. Legal agreement to be entered into by the applicant producer of the audiovisual project approved by the CPFC, in order to regulate the conditions for the allocation of the incentive instruments of Law 1556 of 2012. 

4.5. Colombia Film Promotion Committee. Decision-making body for the incentive instruments of Law 1556 of 2012. In this Manual, it will be identified by the acronym CPFC. 12.6. Bid Bond: Receipt of deposit, according to the instructions of the Management Entity, for the amount of forty (40) SMLMV, as a commitment to the execution of the producer’s obligations. The following rules apply:

12.6.1. Ninety percent (90%) of the value of the bid bond shall only be refunded to the producer (a) in the event that the project is not approved by the CPFC, except in circumstances of untruthful information; or (b) if the project is withdrawn prior to the CPFC’s evaluation. This repayment shall be made without returns or indexation, together with bank charges.

12.6.2. The value of the bid bond will be allocated for the purposes of the FFC upon approval of the project by the CPFC, regardless of the subsequent developments related to the project.

12.6.3. There will be no refund of the bid bond for applications rejected in cases of doubt regarding the veracity of the submitted documents, or in cases falling under any of the current restriction criteria, regardless of the timing of the rejection.
First paragraph. All documents must be submitted in their original language and translated into Spanish, with the exception of the identification document and itemized budgets.
Second paragraph. All documents and requirements set forth in this manual are considered essential for the evaluation of the applications. CERTIFICATES OF AUDIOVISUAL INVESTMENT IN COLOMBIA 32.6. Bid bond: Receipt of deposit, according to the instructions of the Management Entity, for an amount equivalent to two point two percent (2.2%) of the budget of expenditure subject to CINA by the project, not exceeding an amount equivalent to eighty (80) SMLMV. The following rules apply:

32.6.1. Ninety percent (90%) of the value of the bid bond shall only be refunded to the producer (a) in the event that the project is not approved by the CPFC, except in circumstances of untruthful information; or (b) if the project is withdrawn prior to the CPFC’s evaluation. This repayment shall be made without returns or indexation, together with bank charges.

32.6.2. The value of the bid bond will be allocated for the purposes of the CINA system upon approval of the project by the CPFC, regardless of the subsequent developments related to the project.

32.6.3. There will be no refund of the bid bond for applications rejected in cases of doubt regarding the veracity of the submitted documents, or in cases falling under any of the current restriction criteria, regardless of the timing of the rejection.

What does the MAR say about this?

4.10. Feature film. In accordance with the provisions of Article 2.10.1.1, Title I, Part X of Decree 1080 of 2015 and according to the legally adopted definitions, the feature film designates elements that harmonize to constitute it, and comprise an artistic object and cinematographic language, a set of moving images, with or without sound, and a material support that allows them to be fixed.
In line with the preceding paragraph, the expression feature film refers to the concretion and structural conjunction of the aforementioned elements.
The following are not considered feature films:
a. Due to its window: Those made with television as an essential window for public communication, except for feature films intended for television with a duration of not less than 52 minutes, excluding commercials.
b. Due to its series nature: Soap operas, documentaries, series, or works of any genre that are clearly intended to be broadcast on television with identifiable periodicity or under the coverage of the same programming space.
c. Due to its advertising or marketing purposes: Those with the appreciable purpose of advertising or marketing products, institutions, goods, services or any other activity or object.
d. Because of its institutional nature: Those whose purpose is to highlight the image, activity, or services provided by a specific public or private institution. e. By limit of display or hearing of marks: Those that use in an appreciable and/or repetitive manner visualization or sonorous mention of product or service brands, in such a way that it may be understood as an institutional or advertising work.
f. Because of its fundamentally pedagogical purpose: Those whose main purpose is to educate about a fact, product, behaviour, or activity.

4.11. National feature film. That which meets the Colombian nationality requirements (artistic, technical, and economic) set forth in Law 397 of 1997, Decree 1080 of 2015 or in the provisions that modify them.

4.12. Non-national feature film. The one that does not meet the requirements (artistic, technical, and economic) described in the previous numeral.

4.13. Series. Audiovisual work of fiction, documentary, or others approved by the CPFC, which is broadcast or communicated to the public in chapters. This includes reality, short web series, or non-scripted works. In the case of seasonal series, each season is considered a different project, so an application must be made for each one.

4.14. Video game. Audiovisual work, consisting of an interactive application that leads to an experience that allows interaction with the elements contained in it, through the use of audiovisual and software tools.

4.15. Music video. Audiovisual work essentially aimed at representing a musical work or artist. It does not include concert recordings, although it may correspond to concert documentaries that do not correspond to a Colombian cinematographic work, in accordance with the provisions of numeral 4.12.

4.16. Advertising audiovisual production. It is the audiovisual work that has a purpose strictly aimed at the marketing of goods, products, brands or services, among others.

4.17. Non-national audiovisual work. For the purposes of this Manual, a non-national work is a work that has foreign economic participation and is submitted in that amount, by decision of its producer, to the tax rebate under the CINA.
In the case of audiovisual works submitted to the FFC’s Cash Rebate system, their producers, both nationals and foreigners, will decide under which nationality they apply.
This does not apply to cinematographic works, which are subject to the definition of nationality set out in 4.11 and 4.12. For the purposes of the general management of the audiovisual work, the Management Entity may certify that a non-film audiovisual project has the participation of Colombian production companies and therefore has a national component. For this purpose, the relevant documentation shall be requested.

What does the MAR say about this?

4.18. Services in Colombia. According to Decree 1080 of 2015, Article 2.10.3.3.3.4, added by Article 1 of Decree 1091 of 2018, cinematographic or audiovisual services for the purposes of Articles 9 and 14 of Law 1556 of 2012, its amending or regulatory provisions and this Manual:
a. Cinematographic or audiovisual services: specialised activities directly related to the pre-production, production and post-production of feature films or audiovisual works, including artistic and technical services provided by Colombian individuals or legal entities domiciled or resident in the country.
b. Film or audiovisual logistical services: Hotel, food and transport services necessary for the film or audiovisual project.
For the purposes of this Manual, the generic terms audiovisual services will be used to refer to those described in subparagraph ‘a’; and audiovisual logistics services will be used to refer to those described in subparagraph ‘b’.
Together, both modalities of services may be referred to in this Manual as the National Services for the Project.
The National Services for the Project must be provided by Colombian individuals or legal entities, materially and in all respects in Colombia, without room for other interpretations. It is not sufficient that the service is invoiced by a Colombian for the service to be considered a service in Colombia. The Management Entity may verify everything related to the expenses in National Services for the Project that the producer intends to assert for the purposes of the incentives, making unfeasible any recognition of expenses that does not comply with this parameter.
Legal entities must demonstrate domicile in Colombia, understood for the purposes of this Manual as the address of their headquarters in the country.
Colombian individuals must be Colombian nationals and domiciled, i.e. they must have a permanent residential address in Colombia and be resident in the country, understood for the purposes of this manual as having been in the country continuously or discontinuously for no less than 183 calendar days in the calendar year of the expenditure.

What does the MAR say about this?

4.22. Budget of total expenditure in the country: It is the budget submitted by the producer that includes all the items and amounts that will be executed in the country, classified into audiovisual services and audiovisual logistics services, taxes and other expenses. This budget is an integral part of the audiovisual project, if approved by the CPFC.

4.23. Budget of expenditure subject to cash rebate: It is the budget of expenditure on audiovisual services and audiovisual logistical services in the country subject to the FFC’s Cash Rebate, before VAT. This budget excludes non-viable expenditure against FFC’s Cash Rebate.

4.24. Budget of expenditure subject to CINA. It is the budget of expenditure on audiovisual services and audiovisual logistical services in the country eligible for CINA, before the application of VAT. This budget excludes expenditure that is not eligible for CINA.

4.25. Minimum expenditure in the country: Expenditure on audiovisual services or audiovisual logistical services in Colombia, for a minimum amount described in this Manual for each type of audiovisual work eligible for the incentive instruments of Law 1556 of 2012. In this Manual, the concepts of investment and expenditure are considered analogous.
For the calculation of the minimum expenditure, the reference used is the legal monthly minimum wage in effect in Colombia in the year the project is approved.

4.26. SMLMV. Legal monthly minimum wage in force in Colombia, which changes every year. For the purposes of this Manual, the calculation in SMLMV will not take into account the transport allowance.

4.27. Contributions to the Integral Social Security System. These refer to all the contributions or payments foreseen by the Integral Social Security System in force in Colombia destined to guarantee the coverage of benefits of an economic nature, health and complementary services, subject of this law 100 of 1993, or others that may be incorporated in the future.

What does the MAR say about this?

CHAPTER IV FINAL PROVISIONS
45. Article 45. Forms. The Management Entity may adopt formats or forms for any of the documents, requirements, or accreditations established in this Manual. These will be modified by the Management Entity in accordance with any change to this Manual or as long as it is advisable for a better understanding and monitoring of the Incentive Instruments of Law 1556 of 2012. Likewise, the Management Entity may inform applicants about documents or requirements that, according to the typology or type of projects or the characteristics of any project contemplated here that incorporates animations, are framed or correspond to those generally required in this Manual.
The Management Entity will inform applicants of this situation.

46. Article 46. Action through an attorney or agent. The foreign producer may carry out all actions and procedures related to the incentive instruments of Law 1556 of 2012 (including, but not limited to, all those actions and procedures described in this manual) through the film services company or the national co-producing company of the project. In this case, the designated company will act under the figure of Power of Representation or mandate, always in the name and on behalf of the foreign producer, and all relationships, obligations, and rights will be understood exclusively with respect to the latter.

47. Article 47. Voluntary submission. By submitting a project, the producer declares that he is familiar with the regulations of the FFC and the CINA, and that he is in a position and fully willing to voluntarily comply with them.

48. Article 48. Reporting of information. The CPFC, the Management Entity, the Ministry of Culture, Arts and Knowledge or any other entity participating in the incentive systems of Law 1556 of 2012, amended by Law 1955 of 2019, may report information on expense accreditations to the National Tax and Customs Directorate (DIAN), the Financial Research and Analysis Unit (UIAF), or any other administrative or judicial authority that so requires.

49. Article 49. Applications in progress. Projects in the process of application and evaluation are subject to the provisions of this manual.

50. Article 50. Meeting schedule. The CPFC shall publish its meeting schedule annually on the Management Entity’s website, which shall be subject to adjustments as defined by that body.

51. Article 51. Transfer of knowledge. The CPFC may determine, via agreement, the requirements for the transfer of knowledge to the audiovisual community by the producers applying for any of the incentive instruments of Law 1556 of 2012.
Likewise, it may establish, if it deems necessary, minimum requirements for hiring national human talent.

CAPITULO IV DISPOSICIONES FINALES Artículo 45. Formatos. La Entidad de Gestión podrá adoptar formatos o formularios para cualquiera de los documentos, requisitos o acreditaciones establecidos en este Manual. Estos se modificarán por la Entidad de Gestión en consonancia con cualquier cambio a este Manual o en cuanto sea aconsejable para una mejor comprensión y seguimiento de los Instrumentos de estímulo de la ley 1556 de 2012.
Del mismo modo, la Entidad de Gestión podrá informar a los postulantes sobre documentos o requerimientos que, de acuerdo con la tipología o género los proyectos o a las características de algún proyecto de los aquí contemplados que incorpore animaciones, se enmarquen o correspondan a los exigidos en forma general en este Manual.

La Entidad de Gestión informará de esta situación a los postulantes.

Artículo 46. Actuación por intermedio de apoderado o mandatario. El productor extranjero podrá efectuar todas las actuaciones y gestiones relacionadas con los instrumentos de estímulo de la ley 1556 de 2012 (incluyendo, pero sin limitarse a, todas aquellas descritas en este manual), por intermedio de la sociedad de servicios cinematográficos o de la sociedad coproductora nacional del proyecto. En este caso, la sociedad designada actuará bajo la figura de poder o mandato, siempre a nombre y por cuenta del productor extranjero, y todas las relaciones, obligaciones y derechos se entenderán exclusivamente respecto de este último.

Artículo 47. Autonomía de la voluntad. Con la postulación de un proyecto el productor declara que conoce la normativa del FFC y del CINA, y que está en condición y plena disposición voluntaria de acatarla.

Artículo 48. Reporte de información. El CPFC, la Entidad de Gestión, el Ministerio de las Culturas, las Artes y los Saberes o cualquier otra instancia participante en los sistemas de estímulo de la ley 1556 de 2012, modificada por la ley 1955 de 2019, podrá reportar información de las acreditaciones de gastos a la Dirección de Impuestos y Aduanas Nacionales (DIAN), a la Unidad de Investigación y Análisis Financiero (UIAF), o a cualquier otra autoridad administrativa o judicial que lo requiera.

Artículo 49. Postulaciones en curso. Los proyectos en proceso de postulación y evaluación se sujetan a las previsiones de este manual.

Artículo 50. Cronograma de reuniones. El CPFC publicará anualmente su cronograma de reuniones en el sitio web de la Entidad de Gestión, el cual será susceptible de ajustes según lo defina ese órgano.

Artículo 51. Transferencia de conocimiento. El CPFC podrá determinar, mediante acuerdo, las exigencias de transferencia de conocimiento a la comunidad audiovisual, por parte de los productores postulantes, a cualquiera de los instrumentos de estímulo de la ley 1556 de 2012.
Del mismo modo, podrá fijar, de estimarlo necesario, mínimos de contratación de talento humano nacional.

Artículo 53. Supresión de trámites. Como parte de una política de supresión de trámites, la Entidad de Gestión podrá establecer documentos e informaciones que tengan validez definida o indefinida más allá de cada postulación, de manera que se evite la repetición de entrega de documentaciones por postulantes y por proyectos. La Entidad de Gestión podrá definir los formatos, plataformas o formas en este respecto.
Este Manual cobija a los proyectos en ejecución en lo que resulte más favorable respecto del Manual anterior que se deroga mediante este Acuerdo.

Artículo 54. Vigencia y derogatorias. Este acuerdo rige a partir de la fecha de su publicación y deroga el anterior Manual de Asignación de recursos, adoptado mediante el Acuerdo 060 de 2020, con sus modificaciones mediante acuerdos posteriores.

Artículo 11. Artículo 31.Oportunidad. Las postulaciones deben hacerse ante la Entidad de Gestión mediante la plataforma tecnológica que esta determine. En caso de requerirse correcciones, se gestionarán por medio del canal de comunicaciones y plazos que determine tal entidad.

Parágrafo. La Entidad de Gestión únicamente pondrá en conocimiento del CPFC proyectos que en los cinco (5) días hábiles anteriores a la fecha de la sesión cumplan con la totalidad de los requisitos de postulación, incluyendo aclaraciones, subsanaciones y/o correcciones.

What does the MAR say about this?

Article 52. General obligations. The producer applying for any of the incentive systems regulated in this Manual is subject to the following: 52.1. To allow, for strictly cultural, non-commercial purposes, the use of the following, with the exclusive purpose of carrying out activities to promote the Colombian territory for audiovisual work:
A) Images from the audiovisual work designated for the FFC’s Cash Rebate or CINA, with a duration of up to five (5) minutes.
B) Audiovisual testimonials about the making of the work and behind-the-scenes footage.
C) The photographs mentioned in the following numerals.
This authorisation is granted to incorporate the above in public institutional content, and that of the Colombian Film Commission, without time limit, for all known territories, media and formats. The Technical Secretariat may require all the materials listed above according to the characteristics of the project, and may edit, reproduce and publicly communicate the material, as well as distribute it directly or through third parties. The Colombia Filming Contract will establish stipulations in this regard, with the aim of not affecting the premiere of the works, and to reconcile this with the right to use the material.

52.2. To deliver in a timely manner to the Management Entity the copies required to carry out the use referred to in the previous paragraph, in optimum technical quality under industry standards.

52.3. To agree that the Colombian Film Commission may hold a press conference, press launch or similar, confirming the production in the country.

52.4. To arrange with Proimágenes Colombia press releases and information to national and international media in which the effect of the incentive system existing in Colombia for the management of the respective audiovisual work and, in general, for the audiovisual system, is positively publicised.

52.5. To agree on the visit of five (5) government representatives to the set, with at least one person from the main cast and one person from the main technical or artistic team. The Technical Secretariat may invite representatives from the media to this visit.

52.6. To provide a list of locations indicating the geographic location, address, and data of said location.

52.7. To provide the Technical Secretariat with a list with statistical data and in an anonymous form of all Colombian members of the artistic and technical team. 52.8. To submit at least six (6) still photos of the production in full colour and high resolution. These photos must show the cast (actresses or actors) on location, in studios or on construction sites and using prosthetics and animatronics if applicable. Publicity photos of the cast are not sufficient to meet this requirement.

52.9. To deliver at least three (3) video testimonials (the film commission will organize their filming) or three (3) written testimonials from senior members of the international technical and artistic team regarding the experience of producing in Colombia. The crew members to make these testimonials are: director, executive producer, art producer, costume designer.

52.10. At least one department head (preferably non-local) should attend a Q&A session with local industry and/or students during the pre-production or production stage. This session will be organized and moderated by the Technical Secretariat, in order to ensure greater exposure to the industry and to provide knowledge transfer.

52.11. To grant credits to the country and/or to the entities responsible for the incentive instruments of Law 1556 of 2012. These will be defined in the Colombia Filming Contract, taking into consideration the particularities of the types of works covered by them.
First paragraph. Failure to comply with the obligations established in this article authorizes the Management Entity to suspend the issuance of the compliance certificate for the last CINA to be issued, or the disbursement of the FFC consideration, as appropriate.
Second paragraph. The producer and the Technical Secretariat may establish specific parameters for the fulfilment of these obligations of the producer.
The Colombia Filming Contract will establish the obligations of the producer regarding the use of logos, insignia, and recognitions of the government entities related to the allocation of incentives.
Likewise, it will define cases in which, due to the type of production, it is not possible to incorporate such logos or credits into the audiovisual work and the obligations in lieu of this requirement.
The Management Entity will define the forms of compliance with these obligations, taking into consideration the particularities of the types of works covered by them.
Notwithstanding the obligations established in this article, at the time of signing the Colombia Filming Contract, the Management Entity will deliver and review with the producer an Annex with the description of the form of compliance with the requirements established herein.
