What happens if any of the commitments made are not fulfilled?
Proimágenes may suspend the delivery of the last CINA certificate or the corresponding disbursement.

Is it possible to request an increase in the CINA-subject expenditure budget if the expenditure in Colombia exceeds the amount initially approved?
Yes, an additional amount of up to 50% of the previously approved CINA expenditure may be requested. This involves submitting the request to Proimágenes for approval by the CPFC.

Requirements for executing the expenditure

  1. Comply with the minimum expenditure, including taxes.
  2. Make all payments through the trust account.
  3. Ensure that the funds come from abroad, comply with current regulations, and are accredited by the competent financial authorities in Colombia.
  4. Execute the expenditure within the established time frame: maximum 24 months for general projects and 48 months for animation projects.
  5. Allow Proimágenes to verify the activities carried out in Colombia.
  6. Keep the schedule up to date and communicate any changes to the CPFC in a timely manner to avoid delays.
  7. Organize the accounting and tax files (invoices, contracts, and payment receipts) from the outset, which must be available for audit.
  8. During execution, it is possible to request one or more budget increases, up to a maximum of 50% of the initial approved value.

General obligations of the producer

Anyone applying for the incentives regulated by the Resources Allocation Manual (MAR) authorizes the use of materials from their project or their incorporation into public institutional content, without time limits, for all territories, media, and formats. This is for cultural and non-commercial purposes, intended to promote Colombia as an audiovisual production setting.

Producers applying for any of the incentive instruments must comply with the following obligations:

Cultural and non-commercial use of materials
  • Authorize the use of up to five (5) minutes of images from the work.
  • Authorize the use of testimonial and behind-the-scenes audiovisual material.
  • Authorize the use of photographs of the work.
Delivery of materials
  • Deliver the copies required for the use of the authorized materials in optimal technical quality under industry standards.
Dissemination and communication
  • Agree that the Film Commission will organize press conferences, press launches, or similar events.
  • Coordinate with Proimágenes to draft press releases for national and international media to positively publicize the effect of the national incentive system.
  • Agree to the visit of five (5) government representatives to the set with at least one (1) person from the main cast and one (1) person from the main technical or artistic team.
Lists and data
  • Provide a list of locations indicating the geographical location, address, and details of each site.
  • Provide a list with anonymous statistical data on all Colombian members of the technical and artistic team.
Graphic material
  • Provide at least six (6) non-promotional still photos of the cast and the technical and artistic team on location.
  • Provide at least three (3) testimonials, either on video or in writing, from senior international members of the technical and artistic team about their experience filming in Colombia.
Knowledge transfer
  • At least one (1) department head must participate in a question-and-answer session with representatives of the local audiovisual industry or students.
Credits
  • Give credits to the country and the authorities responsible for the incentive instruments of Law 1556 of 2012. These are defined in the Colombia Filming Contract, taking into account the particularities of the types of works covered.

Increase in incentive-eligible expenditure

If a project increases its expenditure in Colombia, the producer may request an extension of the expenditure budget subject to CINA.

During the execution of the contract, it is possible to submit one or more requests for an extension of the budget subject to the incentive, up to a maximum of 50% of the initial approved value.

To request the extension, the producer must submit the following documents to Proimágenes:

  • Summary of the expansion budget [format]
  • Summary of extension consideration [format]
  • Extension request lettern [format]
Remember that…
  • The producer may request the time required to execute the expenditure in accordance with the project schedule, provided that the maximum deadlines established are not exceeded.
  • Proimágenes reviews the documentation and informs the applicant of any observations for correction.
  • Once the documents have been corrected, it issues a verification concept and the extension request is enabled to be submitted to the CPFC.
  • Approved requests are sent to the CPFC at least five (5) business days before the session and must be approved two (2) days prior to submission.
  • The CPFC evaluates the application and may approve or reject it based on priorities and availability.
  • If approved, the expenditure budget subject to CINA is extended to the authorized amount.

Is a new Bid Bond fee required to request the extension?
No.

If approved, is the contract modified?
No, the contract provides for this situation from the outset.

Does the extension cover expenses incurred before the CPFC was approved?
Yes, provided that such expenses were incurred within the term of the contract.

Is it possible to change the film services company or the co-producer?
Yes, with prior approval from the CPFC.

What happens if the deadline for incurring the expense in the country expires?
It is understood that the producer has withdrawn from the project and the quota is released for other projects.

Is it possible to modify the initial schedule?
Yes, provided that the changes are reported and justified in a timely manner to Proimágenes and the CPFC.

36.4. Carry out the proposed activities. The Management Entity may designate a person to witness and verify such activities.

36.5. Comply with the obligations set forth in Article 52 of this Agreement.

36.6. Provide the reports established in this Manual, as well as those required by the CPFC or the Management Entity regarding the project.

36.7. Any other stipulations set forth in the Colombia Filming Contract.

Article 37. Execution of the budget of expenditure subject to CINA. The execution of the expenditure budget of expenditure subject to CINA must comply with the following parameters and requirements:

37.1. Expenditure on audiovisual services and audiovisual logistical services within the budget of expenditure subject to CINA must comply with the minimum established in Article 29 of this Manual, including taxes, subject to the parameters of this Manual. In any case, CINA will only be recognised up to the quota approved by the CPFC.

37.2. Payments and transfers within the budget of expenditure subject to CINA destined for audiovisual services or logistical audiovisual services must be made from the trust entity. This entity may make payments in advance, without limitation, which must be legalized and subject to the accreditations required in this Manual. The respective resources from abroad must be brought in through the exchange system and in accordance with legal regulations; the producer must accredit this before the financial entities or competent authorities.

37.3. For the purposes of the CINA, expenses must be made within a maximum period of twenty-four (24) months from the starting date of the Colombia Filming Contract, except in the case of animation projects where the period may be up to forty-eight (48) months.
The expense is considered made with the transfer by the trust entity to its final recipient.

First paragraph. In any case, each producer, according to the project typology, may indicate the required time according to their schedule, without exceeding the maximum period per project typology, which will be provided for in the Colombia Filming Contract.
Expenses that do not comply with the provisions of this article will not be subject to CINA.
If the maximum period for the project’s completion elapses without fulfilment, it will be understood that the producer has withdrawn.

Second paragraph. During the project’s execution, in the course of the Colombia Filming Contract, the producer may request one or more extensions of the budget of expenditure subject to CINA, up to a maximum of fifty percent (50%) of the initial value presented in Colombian pesos, detailing the additional expenditures to be made and the improvement in the demand for services in the country.

The CPFC may favourably consider or deny such a request based on priorities and the availability of resources. Similarly, it may request any documentation deemed necessary to support the extension.
If the decision is favourable, the budget of expenditure subject to CINA will be increased by that amount. The Colombia Filming Contract will contemplate this scenario from the outset. In this case, it is not mandatory to increase the bid bond.

Regarding the addition, the parameters defined in this Manual for the initially approved expenses will be followed, and in this case, expenditures made prior to the CPFC’s approval of the addition may be covered, provided they are within the term of the Colombia Filming Contract. The period may be extended without exceeding the maximum possible.

FAQ

¿Se puede obtener el incentivo del FFC y del CINA con el mismo proyecto?
No. Los instrumentos son excluyentes. Un proyecto solo puede presentarse a uno de los dos. No se aceptan postulaciones duplicadas ni que sean beneficiarias de la Ley 814 de 2003 (FDC).

¿Puede un proyecto de solo postproducción aplicar?
Sí, al CINA, si cumple el gasto mínimo (COP 630.325.800. ) y se presenta como proyecto independiente. Al FFC únicamente se aplican proyectos que con anterioridad a la postulación hubieran sido destinatarios del FFC para producción.

¿Cuáles son los gastos no cubiertos por los incentivos?
No están cubiertos: gastos fiduciarios, auditorías, administración de valores por depositantes, compras de bienes, ni gastos que no sean servicios audiovisuales o logísticos prestados por personas naturales o jurídicas colombianas.

¿El productor debe ser el propietario de los derechos patrimoniales de la obra?
Sí. El productor, como responsable del proyecto, debe ser titular de los derechos patrimoniales, salvo que se pacte lo contrario legalmente.

¿La sociedad de servicios cinematográficos debe ser coproductora?
No. Puede ser simplemente contratista. Para proyectos no nacionales, los servicios deben contratarse por intermedio de una sociedad registrada como prestadora de servicios cinematográficos, sin necesidad de que sea coproductora.

¿Es necesario que el productor esté legalmente constituido?
Sí. El productor debe ser una persona jurídica (o su equivalente extranjero) legalmente constituida.

En el caso del CINA, debe tratarse de productores extranjeros no declarantes de renta en Colombia.

¿Existe alguna restricción si el productor extranjero tiene filiales en Colombia?
No. Las filiales pueden actuar como sociedades de servicios cinematográficos si están registradas ante el Ministerio de Cultura y su objeto social incluye dichos servicios.

¿Se puede postular una idea para publicidad?
Sí. En producción audiovisual publicitaria se permite postular una idea, con aprobación posterior por parte de la Sociedad de Servicios Cinematográficos.

¿Se pueden postular dos temporadas de una serie en una sola postulación?
No, Cada temporada debe hacer una postulación por separado

¿Cuáles proyectos no pueden postularse?
Aquellos que ya recibieron FFC (excepto postproducción) o CINA, ni beneficiarios de FDC, ni de la ley 814, ni aquellos que tienen vínculos con miembros del CPFC o empresas inhabilitadas.

¿Qué pasa si la postulación del proyecto está incompleta?
No puede agendarse para la sesión del CPFC. Se requiere presentación completa y estar habilitado por la entidad de gestión con al menos 5 días hábiles de antelación.

¿Qué sucede si el proyecto es desaprobado por el CPFC o se retira antes de ser evaluado por el CPFC?
El productor puede solicitar el reintegro del 90% del valor de la cobertura de la seriedad.

¿Qué sucede si el proyecto desiste después de ser aprobado?
El productor puede desistir en cualquier momento, perdiendo el valor de la cobertura de seriedad.

¿Se puede ampliar el presupuesto de un proyecto ya aprobado?
Sí. Hasta el 50% del valor del gasto sujeto a CINA o contraprestación, sin necesidad de suscribir otro sí.

¿Existe un cronograma con fechas específicas para aplicar?
No. La convocatoria está abierta todo el año. FFC se otorga hasta agotar el presupuesto asignado por el Gobierno Nacional; CINA, hasta agotar el cupo fiscal aprobado por el CPFC.

¿Qué ocurre si no se presentan las certificaciones?
Se considera desistimiento. Se libera el cupo asignado.

¿Se pueden emitir varios CINA por un mismo proyecto?
Sí. Se permiten emisiones parciales según los montos acreditados.

¿Puedo fraccionar los CINA de un mismo proyecto?
Sí, el productor extranjero puede negociar el CINA parcial o totalmente. El beneficiario o tenedor del título puede dar la instrucción de la operación por el valor que requiera a través de su depositante directo quien se encarga de realizar los fraccionamientos y cumplir la operación en el Depósito de Valores.

¿Se pueden vender los CINA?
Sí, a personas naturales o jurídicas que sean declarantes de renta en Colombia, en el mercado bursátil a través de una sociedad comisionista de bolsa o una operación extrabursátil en el mercado OTC.

¿Cómo identificar a posibles compradores del CINA?
Una forma es a través de una firma comisionista, que identifica empresas o personas que requieran pagar impuestos de autorretención y renta en Colombia. Otra manera es contactando directamente a personas naturales o jurídicas declarantes del impuesto de renta en Colombia.

¿Puedo negociar los CINA sin un comisionista?
Sí. Es posible hacerlo mediante una operación extrabursátil -OTC- negociación directa entre las partes, requiere al depositante directo para el registro de la operación en el sistema electrónico.

¿Quiénes están habilitados como comisionistas?
Cualquier firma comisionista puede actuar como depositante directo de valores. Cada firma decide si acepta o restringe la custodia o negociación de los CINA.

¿Se puede acceder al CINA sin haber terminado el proyecto audiovisual?
Sí, siempre que se haya acreditado el gasto mínimo exigido por el programa.

¿Cuál es el proceso de recepción del CINA por parte del productor extranjero?
1. El CINA es emitido por el Ministerio de Cultura a través de DECEVAL, a favor del productor extranjero.
2. El productor debe estar vinculado a una sociedad comisionista de bolsa o depositante directo.
3. El depositante directo recibe el CINA en una subcuenta del productor y realiza la instrucción de venta o traslado que le dé el productor.

¿Se pueden usar los CINA como garantía bancaria?
Sí. Pueden hacer parte de un paquete financiero respaldado por flujo de caja, preventas y distribución
